The Electronic Communications and Transactions ACT, 25 of 2002 (“the Act”) makes provision for the signature of certain documents by the use of electronic signatures. The Act further provides certain instances where the use of an electronic signature is prohibited.
Section 4(4) of the Act does not allow electronic signatures for use in the execution of an Agreement for the sale of
immovable property. Thus, a Deed of Alienation for the sale of immovable property still has to be physically signed in “wet ink” for it to be valid. This also extends to any addendums and annexures made in respect of the Agreement.
